Terms of Service

These terms cover your use of The Fan Booster, a software platform and set of services for independent artists. By creating an account or paying for a plan, you agree to them.

1. What you are buying

The Fan Booster gives you access to a hosted software account plus, depending on your plan, setup work, training, and managed services. Plans are described on our pricing page and what is listed there is what is included.

Your plan also includes a membership to Music Funding Academy for as long as your plan is active.

3. Your fans and your data

Your contact list is yours. You can export your full fan list at any time, in a standard file format, for as long as your account exists.

If a payment fails or you cancel:

We do not sell your contacts, and we do not use your fan list to market to your fans on our own behalf.

4. Delivery guarantees

Where a plan states a delivery guarantee, such as your machine being live within a stated number of days, that guarantee applies to work we control. It requires you to supply what we ask for, such as your music, artwork, product details, domain access, and approvals, within a reasonable time. If we miss a stated delivery window for reasons within our control, the remedy stated on the pricing page applies.

We do not guarantee results such as fan counts, streams, sales, revenue, chart positions, or a record deal. Results depend on your music, your audience, and your effort.

5. Distribution access

Certain plans include access to a third-party distribution partner. Access is subject to that partner's own terms, review process, and acceptance. Inclusion of distribution access is not a promise of a record deal, a placement, or any particular commercial outcome.

6. Acceptable use

You agree not to use the platform to send unsolicited messages, to contact people who have not agreed to hear from you, to impersonate anyone, to upload material you do not have the rights to, or to break any law that applies to you.

You are responsible for complying with the rules that govern email and text messaging in your country, including obtaining consent and honoring opt-outs. Accounts used for spam may be suspended without refund.

7. Your content

You keep ownership of everything you upload: your music, artwork, copy, and contacts. You grant us only the permission needed to host and deliver it as part of running the service for you.

8. Third-party services

The platform connects to services we do not control, including payment processors, email and SMS carriers, social platforms, and advertising platforms. Their availability and their terms are their own.

9. Availability

We work to keep the platform running but do not promise uninterrupted service. Planned maintenance, outages at our providers, and events outside our control can interrupt access.

10. Limitation of liability

To the fullest extent the law allows, our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim. We are not liable for lost profits, lost revenue, or lost opportunities.

11. Changes

We may update these terms. If a change materially affects you, we will give notice by email or inside your account before it takes effect. Continuing to use the service after that means you accept the change.
